Refund and Returns Policy – Micky De Jewellers

At Micky De Jeweller, based here on the Gold Coast, we take pride in the quality and craftsmanship of our jewellery. We want you to be delighted with your purchase. This policy outlines our procedures for refunds and returns in accordance with Australian Consumer Law (ACL).
Your Rights Under Australian Consumer Law (ACL)
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
This Refund and Returns Policy does not seek to limit or exclude any rights or remedies you may have under the ACL.
1. Change of Mind Returns
We understand that sometimes a piece isn’t quite right. For most items, we offer a return option for change of mind, subject to the following conditions:
- Timeframe: You must notify us of your intention to return within 14 days of receiving your order.
- Condition of Item: The item must be in its original, unused, unworn condition, with all original tags, packaging, certificates (e.g., diamond certificates), and documentation intact.
- Proof of Purchase: You must provide proof of purchase (e.g., order confirmation, receipt).
- Outcome: For approved change of mind returns, we will issue a In-store credit. Please note that the original shipping costs are non-refundable for change of mind returns.
- Return Shipping: You are responsible for the cost of return shipping for change of mind returns. We strongly recommend using a trackable and insured shipping method as we cannot be responsible for returns lost or damaged in transit.
Items Excluded from Change of Mind Returns:
For hygiene reasons or due to their unique nature, the following items cannot be returned simply because you change your mind:
- Pierced Earrings: For hygiene and health reasons, we cannot accept returns of pierced earrings unless they are faulty.
- Customised or Personalised Items: Items that have been specially made or altered for you, including engraved items, cannot be returned unless they are faulty.
- Gift Cards: Gift cards are non-refundable.
- Items Marked “Final Sale”: Items explicitly marked as non-returnable or final sale are excluded (unless faulty).
2. Faulty or Incorrect Items
If an item you receive is faulty, not of acceptable quality, unfit for purpose, or does not match the description or sample shown, you are entitled to a remedy under the Australian Consumer Law.
If you believe your item is faulty or incorrect:
- Contact Us: Please contact us immediately at hello@mickydejewellers.au or call us on 0431 428 071 within a reasonable timeframe of receiving the item or discovering the fault.
- Provide Details: Please provide your order number, a clear description of the issue, and photographic or video evidence of the fault or incorrect item.
- Assessment: We will assess your claim in accordance with Australian Consumer Law. We may require you to return the item for assessment.
- Remedy: If the item is deemed to have a major failure, you are entitled to choose between a refund, replacement, or repair. If the failure is minor, we may choose to repair or replace the item.
- Return Shipping for Faulty Items: If the item is confirmed to be faulty, we will cover the reasonable cost of return shipping. We will provide instructions on how to return the item.
3. How to Initiate a Return
To initiate any return (change of mind or faulty/incorrect):
- Contact Us: Email us at hello@mickydejewellers.au or use the contact form on our website at our contact page. Please include:
- Your Order Number
- The item(s) you wish to return
- Reason for return (e.g., Change of Mind, Faulty – please describe the fault)
- Attach photos/videos if the item is faulty or incorrect.
- Await Instructions: Do not send the item back until you have received confirmation and instructions from us. We will guide you through the return process.
- Package Securely: If returning an item, please package it carefully in its original packaging (or similar secure packaging) to prevent damage during transit. Include all original contents (boxes, certificates, etc.).
- Ship Item: Send the item to the return address provided in our instructions. For faulty items, we will advise how return shipping costs will be handled (e.g., providing a shipping label or reimbursing reasonable costs). For change of mind, you are responsible for shipping costs and ensuring safe delivery. We recommend using tracked and insured postage.
4. Refunds
- Approved refunds will be processed back to the original payment method used for the purchase.
- Refunds will be processed once we have received the returned item and confirmed that it meets the conditions outlined in this policy.
- Please allow [Specify Number, e.g., 5-10] business days after we have processed the return for the refund to appear in your account, depending on your bank or payment provider.
5. Return Shipping Costs
- Change of Mind: The customer is responsible for the cost and safe return of the item.
- Faulty/Incorrect Item: Micky De Jewellers will cover the reasonable cost of return shipping after the item has been assessed and confirmed to be faulty or incorrect.
6. Conditions of Return Acceptance
Returns may be rejected if:
- The item is not returned in its original condition (unless faulty).
- Tags, certificates, or packaging are missing or damaged (unless faulty).
- The item shows signs of wear, damage, or alteration not related to a manufacturing fault.
- The item is an excluded item (e.g., worn earrings, custom piece) returned for change of mind.
- The return is initiated outside the specified timeframe (for change of mind).
- Proof of purchase is not provided.
